COMUNICADO PPM CAM


COMUNICADO


Ante los últimos acontecimientos, que han afectado a nuestra nación, los Presos Políticos Mapuche de la CAM señalamos a  nuestro pueblo y a la opinión publica lo siguiente:

1.  En el actual escenario de confrontación entre la Nación Mapuche y Estado Chileno, a través de su  gobierno de turno, custodio de los intereses de las empresas privadas y que mantiene militarizado el Wallmapu, con el objeto de abrir paso a las Áreas de Desarrollo Indígena, antesala de nuevas inversiones capitalistas y perpetuación de la usurpación, depredación y dependencia winka.

2. Queremos valorar públicamente el proceso de recuperación territorial llevado adelante  por la comunidad  Ignacio Queipul del Lof Temucuicui, quienes han hecho ocupación efectiva de sus tierras ancestrales, ejerciendo control territorial en el fundo La Romana y Montenegro del latifundista Rene Urban.

3. Que apreciamos, también, la actitud de su werken, peñi Mijael Carbone Queipul, que frente a la condena de 7 años de prisión, como autor de homicidio frustrado a carabineros en acto de servicio, dictada por el Tribunal Oral en lo Penal de Angol, a decidido asumir la clandestinidad.  Alentamos a nuestro peñi a continuar asumiendo con coraje el camino de la rebeldía e instamos a seguir su ejemplo.

4. Queremos también reconocer la valentía de nuestros jóvenes hermanos del Lof Chequenco que se encuentran en huelga de hambre y que fueron condenados a altas penas a través de un indebido proceso.

5.  Finalmente señalamos que el camino hacia la liberación nacional de nuestro pueblo es complejo, lleno de sacrificio y es necesario reconocer cuando la lucha se asume con mayor dignidad, entereza y altura.

CARTA ABIERTA DE LAS ORGANIZACIONES SOCIALES DE VALPARAÍSO A LAS Y LOS PARLAMENTARIOS DE CHILE


 NO A LEY HINZPETER.


Las organizaciones de estudiantes, pobladores, trabajadores, de derechos humanos y ciudadanas de Valparaíso, abajo firmantes, declaramos nuestro absoluto rechazo a la Ley de Resguardo del Orden Público, conocida como "Ley Hinzpeter" que se discute actualmente en el Congreso Nacional. Exigimos a los parlamentarios impedir que se legalice la represión y la vulneración de los derechos humanos, civiles y de libertad de expresión en nuestro país, vulneraciones que se fundamentan implícita y explícitamente en este Proyecto de Ley.
Los argumentos del Gobierno, a través del Ministro del Interior Rodrigo Hinzpeter, intentan convencer al país que esta ley favorecerá la expresión democrática. La lectura y análisis de este cuerpo legal, incluidas las modificaciones planteadas en el parlamento, demuestran que la fundamentación y el "espíritu de la Ley"  buscan impedir, a cualquier costo, la movilización social, criminalizando e invisibilizando las legitimas demandas sociales expresadas por las organizaciones sociales y ciudadanas.
Quienes creemos que los habitantes de este país merecemos vivir en una auténtica democracia, no podemos permitir la aprobación de uno de los mas antidemocráticos proyectos de ley, elaborado en "democracia".
Es una vergüenza que sean organismos internacionales como la ONU y Anmistía Internacional quienes planteen la deslegitimidad de esta ley desde la perspectiva del derecho humano internacional, y que algunos parlamentarios chilenos con ausencia absoluta de sensibilidad y vocación democrática, muestren su incapacidad para oponerse y rechazar en forma clara, categórica, precisa y contundente esta ley, que trae consigo las peores prácticas terroristas desde el Estado hacia sus ciudadanos.
Chile cuenta con suficientes leyes para aplicar frente a eventuales delitos que se puedan cometer en el ejercicio de las libertades públicas, por lo que si de esto se trata, lo que se debe exigir es mayor eficiencia de las policías y de los tribunales. La inoperancia e incapacidad del gobierno, no puede ser resuelta a través de una legislación que restringirá de manera indebida nuestros derechos fundamentales.
Menos legitimidad tiene este intento legislativo, cuando a raíz de las movilizaciones estudiantiles, hemos conocido con horror los abusos y brutalidad policial ejercida contra niños y niñas con denuncias de atentados sexuales, golpizas, detenciones arbitrarias y burdos montajes para inculpar a ciudadanos inocentes de crímenes que jamás cometieron.
Otorgarles mayores herramientas coercitivas a quienes no vacilan en traspasar los límites de la dignidad de las personas, que no respetan los derechos humanos y que mantienen conductas que derivaron en crímenes de lesa humanidad, que aún son materia de investigación, que mienten con descaro, es de una irresponsabilidad inaceptable, por lo que como ciudadanos y ciudadanas estaremos atentos a la conducta de cada parlamentario, especialmente de aquellos y aquellas que dicen representar el campo democrático.
Esperamos que la Ley Hinzpeter sea rechazada con el voto consecuente de cada parlamentario, de lo contrario tendrán que responder ante Chile, su pueblo y la historia por la complicidad en la aprobación de la "Ley Hinzpeter" que convertirá a nuestro país en la primera dictadura en el mundo determinada con voto parlamentario.

Salut à tous.

Mon nom est Juana Rosa Jaramillo Aguilera,  je suis membre de la Commission Ethique Contre la Torture dont je suis la présidente.
Jeudi 23 Août, les étudiants du secondaire ont appelé à une journée de manifestation pour exprimer leurs revendications en matière d'éducation publique gratuite, digne et de qualité, au Chili.
C’est vers 13 heures que j'ai rencontré Leopoldo Monténégro au croissement de la rue Alonso Ovalle et de la rue Zenteno et nous nous sommes dirigés  vers l'Institut National, portant les insignes d’Observateurs des Droits de l’Homme, insignes sur les quelles sont inscrits le nom, le n° de sécurité sociale, une photo, ainsi que le logo de notre organisation. Notre présence avait comme objectif de soutenir les personnes touchées par le gaz dispersé par la police en imprégnant leurs mouchoirs avec de l'ammoniaque pour calmer les effets produits par l'inhalation de ce gaz utilisé à volonté.
Nous avons marché sur San Diego, sur le trottoir est venant du sud de l‘avenue Alameda, il devait être 13h05-13h15 heures. Nous avons observé que les étudiants de l'Institut National sautaient par-dessus le mur  de l'Université du Chili, Il y avait une véritable bataille : beaucoup de sirènes de police, des projections de gaz et de canons lance eau  plus un groupe des Forces Spéciales qui poursuivaient et arrêtaient  des manifestants.
Nous approchions d’Alameda et nous sommes allés  sur le trottoir ouest de San Diego. Là il y a eu une bousculade car les manifestants  ont vu le camion lance eau qui se rapprochait et une escouade des Forces Spéciales avec leurs matraques à la main, tout le monde a couru et moi aussi,  j’étais en train de courir  sur le trottoir ouest de San Diego, lorsqu’une personne en civil m’a  frappée avec son sac à dos sur la cuisse de ma jambe gauche, me laissant incapable de continuer à courir. Il n'est pas possible de savoir quel objet était à l'intérieur du sac à dos. Toutefois, à cause de la douleur produite, je pense qu’il devait y avoir  à l’intérieur des pierres ou quelque chose de très lourd en métal. La douleur que j'ai ressentie a été très intense. Je me suis appuyée contre une personne et j’ai attendu Leopoldo, je lui ai dit que je ne pouvais plus marcher à cause de la violente douleur provoquée par le coup. J’ai tâtée ma jambe à travers mon pantalon et j’ai senti que ma cuisse commençait à enfler. J’ai dû rentrer et je suis retournée à mon travail ou je suis restée assise.
Le vendredi je suis allée voir le médecin qui nous aide, grâce à une alliance avec le CODEPU,  dans les constatations de lésions faites aux manifestants. Il m’a dit que  j’avais  dû être frappée avec un objet plat, qui ne devait pas être une pierre. La blessure est d'environ 14 cm. J’ai été dirigée vers l’Institut de Traumatologie où un autre médecin m’a prescrit des médicaments pour réduire l'inflammation et la douleur, il me fit une injection et me prescrit du repos pour que le muscle blessé puisse cicatriser. Les os ne sont pas atteints.

Ce qui m'est arrivé n'est pas rare, de nombreux civils agissent pendant les manifestations et "soutiennent" le travail des Forces Spéciales faisant des croches pied  aux manifestants qui courent afin qu’ils puissent être arrêtés plus facilement. 
Moi, ils ont voulu me faire tomber pour que je sois victime de la bousculade et qu’ensuite je sois arrêtée.
Il y a beaucoup de gens qui sont arrêtés de cette manière grâce à l’aide de personnes en civil complices de la police.  
Maintenant, nous devons nous préparer pour le mardi 28 août, jour de grève nationale. La répression sera dure à nouveau.

Racconto dell’aggressione da me subita il 23 agosto – Santiago del Cile
Un saluto a tutti e a tutte.
Il mio nome è Juana Rosa Aguilera Jaramillo; faccio parte della Commissione Etica Contro la Tortura nella quale ho l’incarico di presidente.
Giovedì 23 agosto venne indetta dagli studenti della scuola secondaria una giornata di mobilitazione per rivendicare il diritto ad un’Educazione Pubblica, Gratuita, Dignitosa e di Qualità per il Cile.
Verso le 13.00 mi incontrai con Leopoldo Montenegro all’incrocio tra Calle Alonso Ovalle e Calle Zenteno e ci dirigemmo verso l’Istituto Nazionale, indossando i nostri cartellini di Osservatori dei Diritti Umani, cartellini sui quali figurano il nostro nome, il numero di previdenza sociale e la nostra foto, oltre al logo della nostra organizzazione;  la nostra presenza aveva come obiettivo l’assistenza e il sostegno alle persone colpite dai gas dispersi dalla polizia, impregnando fazzoletti con ammoniaca, per calmare la disperazione provocata dall’inalazione di queste sostanze usate a volontà.
Ci dirigemmo per San Diego, marciapiede orientale, da sud verso la Alameda; deve essere stato tra le 13.05 e le 13.15 approssimativamente. Vedemmo gli studenti dell’Istituto Nazionale scavalcare il muro di cinta mentre di fronte all’Università del Cile era in corso una vera e propria battaglia campale: sirene della polizia, gas, un autoblindo con idrante ad alta pressione, agenti delle Forze Speciali che inseguivano e arrestavano i manifestanti.
Ci avvicinammo alla Alameda e attraversammo verso San Diego marciapiede di ponente. Lì si produsse un fuggi fuggi generale di fronte all’idrante e agli agenti delle forze speciali armati di manganelli che si avvicinavano, tutti correvano e anche io. Stavo raggiungendo il marciapiede di ponente di San Diego questa volta dall’Alameda verso sud, quando una persona in abiti civili mi colpì con uno zaino sulla coscia della gamba destra, rendendomi impossibile continuare a correre. Non è possibile sapere cosa ci fosse nello zaino ma dato il dolore che mi produsse pensai che si trattasse di pietre o qualche oggetto metallico molto pesante. Il dolore fu molto intenso. Mi feci aiutare da una persona e aspettai Leopoldo; gli dissi che non potevo camminare e che il colpo mi provocava un dolore enorme; palpandomi attraverso i pantaloni sentii che iniziava la tumefazione. Me ne andai e ritornai al lavoro, dove rimasi seduta.
Venerdì andai dal medico che ci aiuta nella costatazione delle lesioni ai manifestanti feriti, frutto di un’alleanza con CODEPU; mi disse che la lesione di approssimativamente 14 cm era stata provocata da un oggetto arrotondato, non da una pietra e mi mandò da un altro medico, dell’Istituto Traumatologico, lì mi prescrissero medicinali per contrastare l’infiammazione e il dolore, mi fecero delle iniezioni e mi consigliarono riposo per permettere al muscolo danneggiato di cicatrizzarsi. Non avevo danni all’osso.
Quello che mi è accaduto non è inconsueto; molti civili partecipano alle manifestazioni e “supportano gli interventi delle Forze Speciali”, facendo lo sgambetto ai manifestanti che corrono favorendone l’arresto.
Hanno tentato di farmi cadere per farmi travolgere dalle persone in fuga e poi arrestarmi.
Sono molte le persone arrestate grazie all’aiuto velato di personaggi in borghese.
Adesso bisogna prepararsi per martedì 28 per il quale è stato convocato uno sciopero generale. Ancora una volta la repressione sarà dura.

Agresión a Juana Aguilera Jaramillo, Presidenta de la CECT, durante una actividad de observación y apoyo a estudiantes en protesta por sus demandas educacionales no escuchadas por gobierno: 23/08/2012

Relato de afectadaMe llamo Juana Rosa Aguilera Jaramillo; soy integrante de la Comisión Ética Contra la Tortura  y ocupo el cargo de Presidenta.
El jueves 23 de agosto los estudiantes secundarios llamaron a una jornada de marchas territoriales para hacer escuchar sus demandas de Educación Pública, Gratuita, Digna y de Calidad para Chile.
Siendo las 13 horas me reuní con Leopoldo Montenegro en Calle Alonso Ovalle con Zenteno y nos dirigimos hacía el Instituto Nacional, portando nuestras credenciales de Observadores de Derechos Humanos, que lleva nuestro nombre, Rut y foto, además del logo de nuestra organización; nuestra presencia tenía como objetivo, apoyar a las personas afectadas por los gases, impregnando sus pañuelos con amoníaco para que calmaran la desesperación que produce la inhalación de ese elemento usado a destajo.
Caminamos por San Diego, vereda oriente desde el sur hacia la Alameda; debió ser entre las 13:05 y 13:15 horas aproximadamente. Vimos como los estudiantes del Instituto Nacional saltaban por la muralla y en el frontis de la Universidad de Chile, había una verdadera batalla campal: muchas sirenas policiales, gases y el accionar del carro lanza-aguas más un piquete de Fuerzas Especiales que perseguía y detenía a manifestantes.
Nos aproximamos hacia la Alameda y pasábamos hacia San Diego vereda poniente. Allí se produce una estampida de personas que vieron como se acercaba el carro lanza-aguas y un piquete de Fuerzas Especiales con sus palos en las manos; todo el mundo corrió y yo también; estaba ingresando a la vereda poniente de San Diego desde la Alameda al sur, cuando una persona de civil me golpea con una mochila en el muslo de la pierna izquierda, dejándome incapacitada de seguir corriendo. No es posible saber qué objeto había al interior de la mochila. Sin embargo por el dolor que me causó, pienso que podrían ser piedras o algo de metal muy pesado. El dolor que me causó el golpe fue muy intenso. Me apoyé en una persona y esperé a Leopoldo; le dije que no podía caminar que me causaba un dolor enorme el golpe; por sobre el pantalón me palpé y sentí que la hinchazón comenzaba. Me retiré y volví al trabajo donde me quedé sentada.
El viernes fui a ver el doctor que nos ayuda en la constatación de lesiones a los manifestantes heridos y que es fruto de una alianza con CODEPU; me dice que el golpe debe haber sido por un objeto romo; que no es una piedra. La lesión tiene 14 cm aproximadamente; me derivó a otro médico del Instituto Traumatológico; allí me indicaron medicamentos para bajar la inflamación y el dolor; me inyectaron y me recetaron reposo para que el músculo que ha sangrado pueda cicatrizar. No tengo nada en el hueso.

Lo que me ha sucedido no es raro; varios civiles actúan en las marchas y "apoyan" la labor de Fuerzas Especiales" haciéndoles zancadillas a los manifestantes que corren y así esas personas resultan detenidas.
A mi me quisieron tirar al suelo; dejando que sea la propia "estampida" de personas la que se encargue de golpearme y luego quedar detenida.
Hay muchas personas a las que gente de civil ayuda a detener de manera velada.
Ahora hay que prepararse para el martes 28 donde se ha convocada a un paro nacional. Será dura la represión nuevamente.

Police assaults Human Rights Defenders in Chile

Juana Rosa Aguilera Jaramillo, President of CECT, was attacked during an observation activity and support to secondary school students in protest for their still unanswered demands for education: 23/08/2012

Narration from Ms JAJ:
 My name is Juana Rosa Jaramillo Aguilera, I am a member of the Ethical Commission Against Torture of Chile (CECT), and I hold the position of President.

On Thursday, August 23, 2012 High school (secondary) students called for a day of marches in many places of municipalities and over the Chilean territory to voice their territorial demands for free public education, dignity and quality for all Chileans.

I met Leopoldo Montenegro at 13 hours at the intersetion of Alonso Ovalle and Zenteno streets and we headed to the National (Secondary School) Institute, carrying our Human Rights Observer credentials, which bears our name, RUT (national unique ID card number) a photo, plus the logo of our organization. Our presence aimed to support people affected by the gas, providing them with handkerchiefs with ammonia to decrease the anxiety produced by inhaling the different gases used by the police and thrown at the students.

We walked around San Diego, Street, on the east sidewalk, coming from the south towards to Alameda Avenue. It must have been between 13:05 and 13:15 hours. We watched a pitched battle: National Institute students jumped over the wall and into the front of the University of Chile. Many police sirens, gas and the continuous participation of the water cannon police truck plus groups of Special Forces members going after and detaining demonstrators.
We approached toward Alameda crossing to the west sidewalk of San Diego street. There comes a stampede of people who saw the water cannon truck approaching and, again, a squad of Special Forces with their sticks in their hands: everyone ran and I did too. As I was entering the west sidewalk of San Diego street, from the south sidewalk of Alameda Avenue, a civil person hit me with a backpack in the thigh of my left leg. It left me unable to continue running. It is not possible to know which object was inside the backpack. However, for the pain it caused me, I think they could be stones or something made of some very heavy metal. The pain from the blow was very intense. I leaned against a person and waited for Leopoldo. I told him that I could not walk because of the enormous pain from that blow. I felt thigh under my pants realizing that significant swelling has began. I left and went back to work where I sat to rest.

On Friday I went to see the doctor who helps us in checking lesions of those demonstrators who were injured (this as program we have with CODEPU, an other human rights organization). I was told that a blunt object, not a stone, must have hit it. The injury is approximately 14 cm. In diameter. I was referred to another doctor, at the Trauma Institute. There I was advised to have some medications to reduce inflammation and pain and I was injected some medication as well as being prescribed rest to help the healing of my bleeding lesion. Nothing was suspected to be affecting the bone.

What happened to me is not uncommon: many civilians work in the marches and "support the work of Special Forces”, tripping protesters when they run and facilitating their fall and their detention.

The attacker wanted to make me fall on the ground, allowing that the "stampede" of people would hit me and then, be arrested. Many of the people who are arrested are so with participation of people “who help” police. These civilians participate supporting in a veiled way.

Now we must prepare for Tuesday 28 where it has been called a national strike. Repression will be hard again.

Communiqué from the Mapuche people currently sitting-in at UNICEF - Chile


Starting of a HUNGER STRIKE
Comunicado bilingue / Bilingual Communiqué

24 August, 2012,  15:57 hrs.

"After 30 days of the occupation at Santiago (Chile) of UNICEF’s headquarters,
the United Nations agency for the protection of children, we want to make people aware of the indolence of this organization towards the urgent needs of the Mapuche people. We have been flexible with our demands to the UN system:

“Be it known that the State of Chile wages an unequal war against us, and uses its weapons against our children and elderly women. That is why we have taken the decision to start a hunger strike on the premises of the United Nations.

The State has criminalized our struggle, saying that we are terrorists, although we are only people with dignity resisting these injustices. Our unique weapons are our voices that the State wants to silence, as it is the case with our werken (spokesperson) Mijael Carbone Keipul [1] Our beliefs are much stronger: for these reasons we place our body as a shield to prevent this excessive and unnecessary repression against our territory.

We call on all our brothers to develop an active mobilization in order to prevent the silencing of this new injustice against our territory.

From the United Nations we demand the fulfillment of their role, that is, to promote, protect and defend the rights of our people".

Note from translator: One month ago, family members of the Mapuche people occupied the headquarters of UNICEF in Santiago, Chile. Since then they have maintained a sit-in to protest the brutal treatment given to their children, elderly people and women who went to the town of Collipulli to see their relatives who had been previously detained during an uncalled police assault at their own communities and houses. Those children and political prisoners’ relatives were brutally attacked with guns, objects, active physical violence as is now usual on the part of Chile’s militarized police.
The Chilean government and police authorities are silencing and criminalizing this action. The government usually attempts to impose its “standards” (of obedience to the “current legal system”) and force UN, or other organizations, to give in and then demand police the forceful evacuation of any occupants of those premises. UNICEF has not accepted those pressures but no signs of clear, unmistakable denunciation has occurred either. This lack of action for a solution on the part of UNICEF  permits the Chilean authorities to go on with their usual tactics: harassment of those sitting in until people are forced to leave. Repression continues then and “nothing seem to have ever occurred.

Nota del traductor: Hace un mes, los familiares mapuche de menores, mujeres y comunidades agredidas por la policía ocuparon la sede de UNICEF en Santiago, Chile. Desde entonces han mantenido una ocupación (toma) para protestar por el trato brutal que reciben sus hijos, personas mayores y mujeres. Estos fueron a la ciudad de Collipulli para ver a sus parientes que habían sido detenidos durante un injusificado asalto policial de sus propias comunidades y casas . Los hijos y familiares de los presos políticos fueron brutalmente atacados con armas de fuego, objetos y violencia física como es ya habitual por parte de la policía militarizada de Chile.
El gobierno y las autoridades de la policía chilena silencian y ciminalizan estas acciones. El gobierno regularmente intenta imponer sus razones rutinarias (de que es necesario “obedecer al sistema legal actual”) Así, tratan de forzar a Naciones Unidas, o a otras oganizaciones, a llegar al cansancio y eventualmente aceptar las presiones y pedirle a la policía el desalojo forzado de los ocupantes de dichas oficinas. UNICEF no ha aceptado dichas presiones pero no se han visto signos claros, irrefutables, por parte de UNICEF, de denunciar la represión. Esta falta de una acción eficiente por UNICEF permite a las autoridades chilenas coninuar con sus tácticas uinaias: acoso a quienes estén en la toma hasta que la gente se ven forzados de retirarse. “La represión luego continúa y entonces, parece que nada hubiese ocurrido”



[1]  The Tribunal, in collusion with the established powers, is asking for a sentence of 15 years of jail, for a crime he never committed. Actually, only false “witnesses” have been used and the pretended “crime” never even happened. There has been total absence of Due Process, a tradition in Chile’s racist Justice system. The eal crime is that Mijael Carbone has consistently andwith evidences has denounced the continuous diry war againt the Mapuche. And that, for the Chilean establishment is a serious “crime”.

Chile's Ethical Commission Against Torture: A Public Statement


Given the serious human rights violations suffered by Chilean students who demand their legitimate right to education in order to adequately develop their human potentials, the Ethical Commission  Against Torture (CECT-Chile) states:

1. The government must stop repression against young and underage children, and implement its responsibility for maintaining social peace based on justice.
2. It is imperative that Chile's authorities open the door to dialogue in order to overcome social conflict, since dogmatic ideological positions do not help to solve the problems. They rather build them up.
 
3. We want to express our heartfelt repudiation of the torture practices established as institutional policy by Chile's militarized police on the streets, in First Nations, Mapuche territories and in public educational establishments controlled by municipal agencies.
 
4 The State of Chile made the commitment to respect international protection of human rights, including the International Convention Against Torture and Other Cruel, Inhuman or Degrading Acts, as well as those in the Convention on the Rights of the Child, among others. The world has seen the violation of these principles during evictions of schools: children beaten and injured, sexually harassed in vans, buses and police stations, being forced to strip, as well as being victims of "illegal express disappearances", keeping these detainees for long periods and refusing to surrender the information required by family and friends.

5. The measures of Non-Repetition of the crimes of state terrorism inflicted on the people of Chile during the military dictatorship, are part of the Core Principles issued by the United Nations Organization to establish truth, justice and to redress all crimes against humanity, such as those reported here, once more. For  example, today people are mentioning again the murder of Manuel Gutiérrez (16 years, killed one year ago); the detention and disappearance of José Huenante (16 years in 2005); the repression against children of the Mapuche people, etc ... 

Therefore, the State must ensure the end of torture, must investigate all complaints from the affected people, put them to civil justice trials and to condemn those found responsible.
 
6. All international bodies dedicated to  the defense of human rights must monitor these events and Demand from the Chilean government to implement the National Mechanism for the Prevention of Torture, in order to ensure that its National Committee will be directly constituted in the centers suspected of inflicting such offenses and to initiate the relevant investigations.

Information in several languages is coming: Chile's disappearances and repression are now known. Chile's government innocence cannot be claimed by authorities.

GENEVA (9 August 2012) – The United Nations Working Group on Enforced or Involuntary Disappearances* will visit Chile from 13 to 21 August 2012.
"During the mission, the UN experts have examined the main initiatives and policies "undertaken by Chile on issues related to enforced or involuntary disappearances in the "context of the human rights violations in the past.
Comments:
The case of 15 year old minor José Huenante has been reviewed and the conclusions show that Chile's authorities have not make the effort to sort it out. The kidnappers are known, the three of them are Carabineros (uniformed police)  yet the Martial Court (responding to Military Justice and not determined by legal principles but rather by military obedience principles) have prevented any proper justice proceedings. All cases end in revocations of sentences, suspension of trials and, eventually no justice and never a single attempt to make justified reparation of individual and families affected by those crimes. Caso de José Huenante: Naciones Unidas dice que Justicia Militar es un Obstáculo para poner fin a la Impunidad

El Grupo de Trabajo de las Naciones Unidas sobre las desapariciones forzadas o involuntarias (GTDFI) visitó Chile del 13 al 21 de agosto de 2012. Dentro de su  informe preliminar aparece el caso de José Huenante desaparecido desde el 2005 luego de ser detenido por Carabineros de Chile.
Dice el documento que “El GTDFI recibió información del caso del joven José Huenante, desaparecido en 2005 y cuya investigación fue asignada a la justicia militar constituyendo no solo una violación del artículo 16.2 de la Declaración sino un obstáculo clave para poner fin a la impunidad de dicha desaparición forzada. Casos como el de José Huenante deben ser investigados de manera rápida y eficaz por la justicia ordinaria. En este sentido, se solicita al Estado chileno que revise y modifique la normativa interna adecuándola a los estándares internacionales de modo que la jurisdicción militar, de existir, no sea competente en casos de desapariciones forzadas ni otras violaciones de los derechos humanos. En particular, la Policía de Carabineros de Chile debe estar sometida a la jurisdicción ordinaria en el conocimiento de cualquier acto ilícito cometido por sus miembros”.
Hace más de seis años, el 3 de septiembre de 2005 José Huenante, joven mapuche de 16 años, fue detenido por un grupo de Carabineros en la población Mirasol de Puerto Montt. Desde entonces se desconoce su paradero. La alarma ciudadana fue inmediata, no así para el poder judicial que aún no ha podido esclarecer la verdad sobre el destino de José Huenante Huenante.
Según, Cecilia Huenante, madre del desaparecido, su hijo salió de la casa a eso de las 20 horas del 2 de septiembre. Más tarde, cerca de las 2:30 horas del 3 de ese mes, según testigos protegidos por la investigación, se presume que Huenante se enfrentó a Carabineros en plena Avenida Vicuña Mackenna donde más tarde fue subido al radio patrulla (RP) N°1375 perteneciente a la 5ta Comisaría de la sureña ciudad. Desde ese momento nadie lo ha vuelto a ver.

The Working Group of the United Nations on Enforced or Involuntary Disappearances (WGEID) visited Chile from 13 to 21 August 2012. In its preliminary report Jose Huenante has been missing since 2005 after being arrested by Chilean police.
The document says that "The information received by the WGEID indicated that young Joseph Huenante, disappeared in 2005. His  investigation was assigned to the Military Courts constitute not only a violation of Article 16.2 of the Declaration but a key obstacle to ending impunity for this disappearance. Cases like José Huenante must be investigated quickly and effectively by the ordinary courts. In this sense, the Chilean State is requested to review and amend the internal rules adapting to international standards so that military jurisdiction, if any, does not have jurisdiction in cases of enforced disappearances and other human rights violations. In particular, the Carabineros police should be subject to general jurisdiction whenever there is knowledge of any unlawful act committed by its members. "
More than six years, the September 3, 2005 Joseph Huenante young Mapuche 16, was arrested by a group of police in the town of Puerto Montt Mirasol. Since then his whereabouts are unknown. Town citizenry was immediately alarmed, but the judiciary authorities (Martial Court) have not yet been able to establish the truth about the fate of Jose Huenante Huenante.

According to Cecilia Huenante, mother  of the missing boy, her son left the house at about 20 pm on Sept. 2. Later, around 2:30 pm on the 3rd of that month, according to research by protected witnesses, presumably Huenante faced police at Avenida Vicuña Mackenna where he was later boarded the a police patrol vehicle (RP) No. 1375 belonging to the 5th police station in the southern city. Since then nobody has seen him.

Amnesty International: "Chile: several children injured after violent eviction"

Many human rights organizations, both in Chile and Internationally, have denounced these situations.   UNICEF's headquarters in Chile are occupied by relatives of Mapuche children who have been brutally attacked by Chile's police Special Forces. The government offers no solutions to pacific demands made within the context of Covenant 169 of ILO. But Chile's authorities do not respect it, leaving space only for repression. 

A similar situation exists with secondary and university students demands.

The Chilean authorities must initiate a thorough, independent investigation into the police use of force during and after an eviction that resulted in a dozen Indigenous community members – including children – being detained, with many suffering injuries, Amnesty International said.

On 23 July, police officers (carabineros) reportedly moved in to evict a group of Mapuche Indigenous people who a day earlier had occupied a plot of agricultural land in Ercilla – 600 km south of Santiago – as part of an ongoing protest to reclaim their traditional territory in Chile’s Araucanía region.

According to reports, twelve Mapuche Temucuicui community members – including women and children – were taken into custody, with several injured as police fired buckshot and used tear gas during the eviction. At least four other Mapuche children were injured when police fired buckshot at demonstrators who had gathered outside Collipulli Hospital, where their injured friends and family members had been taken.

Amnesty International Americas Researcher Maria Jose Eva Parada said:

“The accounts from the forced eviction in Ercilla point to a possible disproportionate use of force by the police, and the reports of children being injured by police firing buckshot into the crowd outside the Collipulli hospital are especially worrying.

“The investigation into the incidents must be thorough, impartial and independent and, if it finds that police overstepped the boundaries of the law, those responsible must be brought to justice.”

Following the eviction, Chilean President Sebastián Piñera reportedly said that the incidents would be investigated and that, although his government supported the police force “100 per cent”, they would not be allowed to act outside the framework of the law.

Numerous Mapuche Indigenous communities across southern Chile have long protested to have their traditional territories restored to them. Chile

A day after the eviction in Ercilla the authorities responded by publishing a “Special Security Plan for the Araucanía Region” which aimed at combating criminal activity in the course of the protests. However, the Mapuche Indigenous peoples’ territorial claims remain unresolved. 

Maria Jose Eva Parada added:

“Whatever measures are taken to tackle social conflicts arising from Mapuche ancestral land claims in the Araucanía, human rights must be respected.”

Chile's government represses students' demands for better and free education

As part of Chile’s refusal to negotiate with students’ demands their right to quality education, Chile’s government continues to reply with incresing repression.

Uniformed police have besieged the National Institute (IN is Chile’s most prestigious Public Secondary School)

Today IN's students were not admitted to class. Chilean police have surrounded the site with a skunk truck and there were Special Police Forces (GOPE) agents and two Special Forces buses. (Students are detained for hours in these buses and subjected to tortures and sexual harassments)

* A police contingent with buses, water cannon trucks (guanaco) and moving into Santiago’s core centre. Some students tried to speak with Mayor Zalaqutt and walk towards the center of Santago. (Santiago’s Mayor, Zalaquett, is one of the hardest opposers of students’ demands and an enforcer of repressive measures.)
Another group of students was marching towards Providence (the mayor in that sector is a known former man of Pinochet and participated n those years as trainer of torturers! It is Labbé).
Children resist and have been severely violated. This morning eight of them were arrested while doing a hunger strike with chains tied to the bars of the Lyceum INSUCO (Superior Institute of Commerce) from which they were expelled this week for having takien part in the protests of 2011!

Please, share and demand Chile’s diplomatic representations to stop repression and sit down to solve the education crisis. Chile has the worst equity and quality education of all OCDE countries.  (Students and Human Rights Organizations support students’ struggle and demand respect for their rights)

Comme vous le savez, le siège de l'UNICEF à Santiago, au Chili, a été occupé le 26 Juillet par trois femmes appartenant à des Mapuche "Alliance territoriale», l'une d'elles avec son fils de deux ans, pour protester contre les agressions de la police chilienne dans leurs communautés, ce qui est une grave atteinte aux droits humains des citoyens, en particulier les enfants, terrorisés par la violence de l'État perpétrée contre eux.

Monsieur Tom Olsen, représentant de l'UNICEF au Chili leur a permis de rester à l'intérieur de l'enceinte, sans risque d'expulsion forcée, mais n'a pas répondu à leurs demandes d'intervenir auprès du Ministère de l'Intérieur
pour le retrait des forces de police des communautés mapuche dans la région d'Araucanie.

C'est la raison qui nous motive à vous présenter
cet appel urgent afin intervenir dans ce conflit qui touche le droit international des enfants, qui méritent une meilleure protection car ils sont victimes de crimes comme des blessures graves, tels qu'inscrits dans la Convention 169 de l'OIT, en particulier l'article 3.


En vous remerciant de l'attention que vous voudrez bien prêter à notre demande, nous vous saluons respectueusement.

Como es de vuestro conocimiento, la sede de la UNICEF de Santiago de Chile, fue tomada el 26 de julio pasado por tres mujeres Mapuche pertenecientes a la “Alianza Territorial”, una de ellas acompañada de su hijo de dos años, en protesta a las agresiones constantes de las fuerzas policiales chilenas a sus comunidades, violando así gravemente los derechos humanos de su gente, y en particular de las niñas y niños, aterrorizados por la violencia estatal ejercida contra ellos.
El señor Tom OLSEN, representante de la UNICEF en Chile les ha garantizado su estadía al interior del recinto, sin riesgo de desalojo forzado, pero no ha respondido a sus demandas de solicitar al Ministerio del Interior el retiro de las fuerzas policiales de las comunidades Mapuche de la Región de la Araucanía.
Esta es la razón que nos motiva a dirigirles este llamado urgente para intervenir en este conflicto contemplado en el derecho internacional de los Derechos Humanos de los Niños, que merecen una mayor protección en tanto víctimas del delito de lesiones graves, consagrado en la Convención 169 de la OIT, particularmente en su Artículo 3.
